Xalapa, Ver.- Diversas resoluciones de la Suprema Corte y del TEPJF han abordado el tema de la sobrerrepresentaci\u00f3n y sentaron precedentes en la distribuci\u00f3n de asientos \u00a0en anteriores Legislaturas del Congreso de la Uni\u00f3n, seg\u00fan una investigaci\u00f3n de la Direcci\u00f3n General de An\u00e1lisis Legislativo del Instituto Belisario Dom\u00ednguez (IBD).<\/span><\/p>\n<p><span data-originalcomputedfontsize=\"16\" data-removefontsize=\"true\">El estudio titulado \u201cRegulaci\u00f3n y criterios en materia de sobrerrepresentaci\u00f3n de los partidos pol\u00edticos y coaliciones en el Congreso de la Uni\u00f3n\u201d, elaborada por las investigadoras Mar\u00eda Cristina S\u00e1nchez Ram\u00edrez y Susana Ram\u00edrez Hern\u00e1ndez, se\u00f1ala que el principio de proporcionalidad en materia electoral fue objeto de estudio en la acci\u00f3n de inconstitucionalidad 6\/1998, resuelta por la SCJN el 23 de septiembre de 1998.<\/span><\/p>\n<p><span data-originalcomputedfontsize=\"16\" data-removefontsize=\"true\">En aquel a\u00f1o, la Corte emiti\u00f3 una jurisprudencia que reconoci\u00f3 que el principio de representaci\u00f3n proporcional es un mecanismo para garantizar la pluralidad en la integraci\u00f3n de los \u00f3rganos legislativos.<\/span><\/p>\n<p><span data-originalcomputedfontsize=\"16\" data-removefontsize=\"true\">En ese sentido, el m\u00e1ximo tribunal estableci\u00f3\u00a0 \u201cque la proporcionalidad en materia electoral, m\u00e1s que un principio, constituye un sistema compuesto por bases generales tendentes a garantizar de manera efectiva la pluralidad en la integraci\u00f3n de los \u00f3rganos legislativos, permitiendo que formen parte de ellos candidatos de los partidos minoritarios, e impidiendo, a la vez, que los partidos dominantes alcancen un alto grado de sobre-representaci\u00f3n\u201d<\/span><\/p>\n<p><span data-originalcomputedfontsize=\"16\" data-removefontsize=\"true\">El TEPJF, por su parte, a trav\u00e9s de sentencias emitidas en los a\u00f1os 2007 y 2021, ha interpretado los l\u00edmites a la sobrerrepresentaci\u00f3n legislativa regulada por el art\u00edculo 54 constitucional.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-originalcomputedfontsize=\"16\" data-removefontsize=\"true\">De acuerdo con las investigadoras, las resoluciones previas del Poder Judicial se han orientado a garantizar la representaci\u00f3n de todas las fuerzas pol\u00edticas que obtuvieron el porcentaje m\u00ednimo de votaci\u00f3n requerido, equilibrar la toma de decisiones y fortalecer el trabajo legislativo.<\/span><\/p>\n<p><span data-originalcomputedfontsize=\"16\" data-removefontsize=\"true\">El estudio completo se puede consultar en la siguiente direcci\u00f3n electr\u00f3nica:<\/span><u><a id=\"m_4465344515441188805OWAa1fe9872-cca5-028a-b989-7d6527e4ad43\" href=\"http:\/\/bibliodigitalibd.senado.gob.mx\/handle\/123456789\/6284\" target=\"_blank\" rel=\"noopener\" data-originalcomputedfontsize=\"16\" data-removefontsize=\"true\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/bibliodigitalibd.senado.gob.mx\/handle\/123456789\/6284&amp;source=gmail&amp;ust=1723513397024000&amp;usg=AOvVaw2xEjekC_nbINwNDbDg1xXB\">http:\/\/bibliodigitalibd.<wbr \/>senado.gob.mx\/handle\/<wbr \/>123456789\/6284<\/a><\/u><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La sobrerrepresentaci\u00f3n regulada por el art\u00edculo 54 constitucional ha sido objeto de impugnaciones en el pasado\u00a0y revisada por \u00f3rganos jurisdiccionales.
